Uber Screwed Me (But At Least It Bought Me Breakfast!)

uber-finger1I?ve been a wonderful state of bliss for the past week boating in North Carolina (did ya miss me? I missed you). But I came back today and I?m still pretty pissed at Uber for charging me $97 for a $65 ride to the airport last Friday. More importantly, the charge worries me about the company's future. Last Friday I needed to get from my apartment (by AT&T Park) to SFO. Simple, right?

Miss China crowned Miss World 2012, in China

Miss China won the coveted title of Miss World on Saturday, triumphing on home soil during a glitzy final held in a mining city on the edge of the Gobi desert.

The mostly Chinese audience erupted in cheers, and fireworks lit up the sky, when it was announced that the home candidate, Yu Wenxia, had been awarded the coveted title.

"When I was young I felt very lucky because so many people helped me, and I hope in the future I can help more children to feel lucky," Yu, a 23-year-old aspiring music teacher said when asked why she should be crowned.

Yu, who became China's second Miss World winner, appeared on stage in a dazzling array of ballgowns during the two-hour final and serenaded the audience with a piercing rendition of a popular Chinese song.

Last year's Miss World, Ivian Sarcos of Venezuela, handed over her crown to Yu, who wore a sparkling blue dress, in the futuristic Dongsheng stadium in the northeastern city of Ordos.

Miss Mexico, Mariana Reynoso, had been the bookmakers' favourite for the title, but failed to make the last seven candidates despite a strong showing in the early rounds of the pageant. Miss Wales, Sophie Moulds, came in second, while Miss Australia, Jessica Kahawaty, finished third.

The final, watched by a worldwide TV audience of an estimated one billion viewers, included a nod to the culture of Inner Mongolia, with a performance by a group of Mongolian musicians playing the erhu, a traditional two-stringed instrument.

Ordos, which sits around 700 kilometres (440 miles) from the nearest beach, was an unlikely setting for the world's biggest beauty pageant.

The city has grown rich over the past decade on the back of a coal mining boom that has transformed it from a sandstorm-afflicted backwater into one of the wealthiest places in China.

The boom triggered a frenzy of building in the city, but the local government has struggled to fill the vast tower blocks that sprung up, earning it the title of China's biggest ghost town.

However, enthusiastic competitors seemed unfazed by the locale, expressing optimism that with the help of the pageant, the city could leave its reputation behind and take its place alongside other global centres of glitz and glamour.

"Ordos could be the next Dubai," Marielle Wilkie, representing the Caribbean nation of Barbados, confidently predicted.

Albanian contestant Floriana Garo chimed in with her own bold statement.

"In ten years, this city will be booming," she said.

Architecture in Ordos, where the city museum is shaped like an undulating blob, is "world class," added Markysa O'Loughlin, representing St. Kitts and Nevis, also in the Caribbean.

Contestants churned yoghurt in a nomad's yurt and donned local dress to climb sand dunes during their month-long stint in China. Video clips shown during the final showed the beauty queens posing in swimwear on desert sand dunes.

A total of 116 contestants -- the highest ever number to take part -- took to the stage during the final in a variety of stunning gowns.

A red ceremonial flag was passed over to representatives from the Southeast Asian resort island of Bali, hosts of the 2013 Miss World Final, during the ceremony.

While the popularity of the contest, first held in 1951, has waned in the West, continued interest in Asian countries ensures that the final rakes in a huge global television audience.

Sweden's Kiki Hakansson was the first Miss World, while Oscar-winning US actress Halle Berry was a finalist in 1986 and Bollywood star Aishwarya Rai took the crown in 1994.

Venezuela has produced the most Miss Worlds, with six winners, while India and Britain claim five titles each.

The IT&S Manager (IT&SM) role is accountable for all IT&S services to Finance and Tax, defining and driving stakeholder management and strategic alignment between Finance, Tax and IT&S. Develop a detailed understanding of the Finance and Tax processes and strategy
Work with Finance and Tax to ensure the operational and investment portfolio is aligned with the strategy and processes and use these to drive portfolio activities
Advise Finance & Tax on the selection and use of technology and process improvements to meet their objectives and enhance business performance

Monitor for the emergence of anticipated benefits (typically specified as part of the business case for a change programme or project). Optimise the business impact of individual and combined benefits
Provide effective leadership to the portfolio, delivery and business team, and take appropriate action where performance and outputs deviate from agreed tolerances.
Work with the Applications Managers and Business Sponsors to review service delivery and ensure that targets are met, identifying actions to maintain or improve levels of service

Be a proactive participant in programme / project reviews and a point of escalation making interventions and escalations to relevant stakeholders if delivery commitments are likely to be impacted

As Earth orbits the sun, it exerts a gravitational pull that makes the sun ?wobble? to and fro at a rate of up to nine centimeters per second. This so-called radial velocity variation is what astronomers often measure to find exoplanets. Yet their instruments are only sensitive enough to turn up large exoplanets?some of them many times more massive than Jupiter?that can exert a tug of more than one meter per second. A group of researchers at Germany's Max Planck Institute for Quantum Optics has developed a calibration technique using a device called a laser-frequency comb to make radial velocity searches more sensitive. It will make it easier to find smaller, potentially Earth-like planets that may be hospitable to life.

Remember those colorful sticky hands that you used to buy for a quarter from grocery store vending machines? Yeah, this is kind of like that -- except that it's a freaking robot. DARPA is currently working to develop low-cost silicone robots that use both air and fluid to control movement, color and temperature. In the following video, you can see one of these soft contraptions as it journeys onto a bed of rocks and then uses colored liquid to blend into its surroundings. Don't expect this glorious sticky hand to break any land speed records, however; the silicone bot can travel approximately 40 meters per hour, or up to 67 meters per hour without the fluid. (Even the 30 second video, which goes at a snail's pace, has been sped up five fold.)

The current demonstration implements a tethered solution as the robot's source of power, pumps, gasses and liquids, but future developments may allow for a self-contained system. Further, rather than improving the robot's speed, its developers will instead focus on its flexibility as a means for navigating within tight spaces. Be sure to peep the video below, and we think you'll agree that DARPA's creation easily puts those sticky hands to shame.

Oracle To Pay Fine Over India Bribery Charge


Washington: Software giant Oracle has agreed to pay $2 million to settle US regulators' charges that its Indian subsidiary violated foreign anti-bribery laws by secretly setting aside money to make unauthorized payments to phony vendors.


In a complaint filed with the federal court in San Francisco, the US Securities and Exchange Commission (SEC) Thursday alleged that during a period between 2005 and 2007, employees at Oracle India had distributors keep some funds off the books.


On 14 different occasions during the course of executing eight government contracts there, some Oracle India employees added some extra "margins" to deals they did with local distributors, it alleged.


The funds piled up to $2.2 million and were used to make payments to third parties, some of which proved to be either non-existent entities or storefronts, SEC said.


For example, according to the SEC's complaint, Oracle India secured a $3.9 million deal with India's ministry of information technology and communications in May 2006.


As instructed by Oracle India's then-sales director, only $2.1 million was sent to Oracle to record as revenue on the transaction, and the distributor kept $151,000 for services rendered.


Certain other Oracle India employees further instructed the distributor to park the remaining $1.7 million for "marketing development purposes".


Two months later, one of those same Oracle India employees created and provided to the distributor eight invoices for payments to purported third-party vendors ranging from $110,000 to $396,000.


In fact, none of these storefront-only third parties provided any services or were included on Oracle's approved vendor list, the SEC complaint said.


Thursday's settlement involved no admission of wrongdoing, but in a statement Oracle said: "In 2007, Oracle discovered that a few employees of its Indian subsidiary apparently had directed distributors to maintain side funds in violation of Oracle business practices.


"Following a thorough investigation, the employees involved were terminated. Oracle disclosed the matter to the government and has cooperated with the SEC in its investigation, culminating in today's announcement of a $2 million settlement."


"Through its subsidiary's use of secret cash cushions, Oracle exposed itself to the risk that these hidden funds would be put to illegal use," said Marc J. Fagel, director of the SEC's San Francisco Regional Office.

J&J to remove harmful chemicals from adult products by 2015: NYT

(Reuters) - Johnson & Johnson announced plans to eliminate several harmful chemicals like formaldehyde from its line of consumer products meant for adults by the end of 2015, the New York Times reported on Wednesday.

The latest move comes after the company said in November it was phasing out formaldehyde-releasing preservatives from its baby products. The diversified healthcare company is extending the program to include well-known drugstore brands like Neutrogena, Aveeno and Clean & Clear, the paper said.

"We've never really seen a major personal care product company take the kind of move that they're taking with this," said Kenneth Cook, president of the Environmental Working Group, one of the organizations that has been negotiating with company officials to change their practices, the paper said.

J&J previously said it had been reducing the use of formaldehyde-releasing preservatives from its baby products since 2009 when the Campaign for Safe Cosmetics first raised concerns with the company about its baby shampoo.

Formaldehyde is considered to be a possible trigger for some cancers and skin allergies.

Susan Nettesheim, vice president for product stewardship and toxicology for the company's consumer health brands, said the project was a major undertaking and would require extensive spending on research and development to find alternatives, the Times said.

The cost of the project was not revealed by the company, the paper said.

J&J officials could not be reached by Reuters for comment.

UN to consider new Syria office after observers go

UNITED NATIONS (AP) ? The Security Council on Thursday will debate whether to establish a new civilian office to support U.N. and Arab League efforts to end the 18-month conflict in Syria as the U.N. military observer mission comes to an end Sunday.

The council had set two conditions for possibly extending the mission of the unarmed observers past Aug. 19: a halt to the government's use of heavy weapons and a significant reduction in violence. In a letter to the council last Friday, U.N. Secretary-General Ban Ki-moon said neither condition was met and Syria now risks "a descent into a full-scale civil war."

But with the end of the unarmed observer mission looming, Ban said, "it is imperative for the United Nations to have a presence in Syria" aside from its humanitarian operation in order to support U.N. and Arab League efforts "in mediating and facilitating a peaceful resolution to the crisis."

"I intend therefore to work in the immediate future towards establishing an effective and flexible United Nations presence in Syria that will support our efforts with the parties to end hostilities," Ban said.

France's U.N. Ambassador Gerard Araud, the current Security Council president, said members will be discussing the observer mission and Ban's proposal at a closed meeting on Thursday where they will be briefed by Assistant Secretary-General for Peacekeeping Edmond Mulet.

"I think there is a consensus among the members of the Security Council that we need to have a U.N. presence remaining in Damascus, in Syria, after Aug. 20," Araud told reporters on Wednesday. "We'll see whether it's possible to have a consensus around the proposal of the secretary-general."

The Security Council initially authorized the 300-strong observer mission to deploy to Syria for 90 days to monitor implementation of a six-point peace plan brokered by U.N.-Arab League envoy Kofi Annan. The plan was to start with a cease-fire and withdrawal of the government's heavy weapons and culminate with Syrian-led political talks.

President Bashar Assad's government and opposition forces agreed to the plan, but it was never implemented.

Because of the worsening bloodshed and insecurity, the observers have been mainly confined to their hotels since June 15 and their numbers have been cut by about two-thirds.

The U.N. said Wednesday that 110 observers remain in Syria, mainly in Damascus. A bomb exploded Wednesday outside their hotel, wounding three people, but no observers were hurt.

Frustrated at the escalating conflict and the failure of world powers on the Security Council to unite to stop the chaos, Annan announced last month that he was resigning effective Aug. 31.

Ban told reporters in East Timor on Wednesday that he is expediting the selection of a successor to Annan, and he again urged government and opposition forces to stop the violence and start a political dialogue.

"More than 18,000 people have been killed during the last 18 months," Ban said. "The Syrian people have suffered too much too long. The international community must feel the sense of collective responsibility on this situation. How long do we have to endure this kind of a tragedy? This is not justice and this is not acceptable."

On Tuesday, a spokesman for Annan said Syrian authorities have backed former Algerian Foreign Minister Lakhdar Brahimi, a veteran U.N. troubleshooter in hotspots including Afghanistan and Iraq, as his successor, but it was unclear whether Brahimi had accepted the post.

Several U.N. diplomats, speaking on condition of anonymity because no announcement has been made, said Brahimi wants a signal of support from the deeply divided Security Council. Russia and China have vetoed three Western-backed Security Council resolutions that would have stepped up pressure especially against the Syrian government by threatening sanctions if the fighting didn't stop.

France's Araud said he had no information about Brahimi but told reporters that any candidate to replace Annan has to take into account the council divisions and the situation on the ground. At the moment, both sides believe they can win militarily and there is no prospect of a political transition, he said.

"It's a bit (of an) impossible mission. So I do understand that people hesitate to take this mission, but ... we need to have somebody who could be available if there is any prospect of launching a political process," Araud said. "The U.N. simply can't leave the room."

Islamic group suspends embattled Syria

The Organisation of Islamic Cooperation suspended Syria on Thursday, saying the Muslim world can no longer accept a government that "massacres its people", further isolating the embattled regime.

The move by the world's biggest Muslim grouping came after dozens of people, including women and children, were reported killed in an air strike on a rebel bastion in northern Syria, while a bomb attack and a firefight rocked Damascus.

UN investigators also said Syrian forces had committed crimes against humanity, including the Houla massacre in May that shocked the world, during an escalating conflict that has killed thousands and sent many more fleeing.

Violence continues to rage in many parts of the country, including the northern battleground of Aleppo, with bitterly divided world powers in deadlock over how to end a conflict that could threaten the entire region.

The UN Security Council meets Thursday to formally end its observer mission in Syria, as UN chief Ban Ki-moon struggles to persuade Algerian diplomat Lakhdar Brahimi to become the new international envoy on the conflict.

An emergency OIC summit in the Saudi holy city of Mecca said it had agreed to suspend Syria because of "deep concern at the massacres and inhuman acts suffered by the Syrian people".

OIC chief Ekmeleddin Ihsanoglu said the decision sent "a strong message from the Muslim world to the Syrian regime" of President Bashar al-Assad.

"This world can no longer accept a regime that massacres its people using planes, tanks and heavy artillery."

The United States and the opposition Syrian National Council welcomed the move.

"Today's action underscores the Assad regime's increasing international isolation and the widespread support for the Syrian people and their struggle for a democratic state that represents their aspirations and respects their human rights," State Department spokeswoman Victoria Nuland said.

A damning report by the UN Commission of Inquiry said government forces and their militia allies committed crimes against humanity including murder and torture, while the rebels had also carried out war crimes, but on a lesser scale.

"The commission found reasonable grounds to believe that government forces and the shabiha had committed the crimes against humanity of murder and of torture, war crimes and gross violations of international human rights law and international humanitarian law," the report released on Wednesday said.

It said they were responsible for the massacre in the central city of Houla in May when 108 civilians, including 49 children, were killed in a grisly attack that Assad himself had said was the work of "monsters".

Rebel fighters were however not spared in the probe, which found them guilty of war crimes, including murder, extrajudicial execution and torture.

The conflict erupted in March last year when regime forces cracked down on peaceful protests but has spiralled into an armed rebellion that activists say has killed 23,000 people while the UN puts the death toll at 17,000.

Assad -- who says he is fighting a foreign "terrorist plot" -- has been hit by a wave of defections and a rebel bomb attack that took out four of his top security officials last month.

In the north of Syria, activists and residents reported another atrocity by the regime, with dozens killed in an air strike in Aazaz, a rebel bastion near the second city Aleppo.

"Bashar did this. God help us, these animals will kill us all," said one man, hoisting a bloodied arm from a pile of body parts on the pavement outside the local hospital.

Dozens of residents fled for nearby Turkey, many of them entire families carrying boxes of clothing and food on their heads.

The Syrian Observatory for Human Rights said 31 people were killed, including women and children, and another 200 wounded, while Turkey, which took in many of the victims, said on Thursday that another 15 had died of their injuries.

Nationwide, at least 167 people were killed on Wednesday, the Observatory said.

UN humanitarian chief Valerie Amos also warned that the situation in Syria was worsening, with the number of people in need possibly as high as 2.5 million.

And in a worrying development in neighbouring Lebanon, rioters blocked roads and dozens of Syrians were kidnapped and their shops vandalised in violence that triggered orders from Gulf nations for citizens to leave immediately.

Saudi Arabia, the United Arab Emirates and Qatar all issued warnings for their nationals to leave because of what the UAE foreign minister said was a "very dangerous" situation.

In New York, the Security Council meets Thursday to formally end its observer mission with entrenched divisions among the major powers meaning there is no hope of a renewal when its mandate ends at midnight Sunday.

Ban -- who has branded the conflict a "proxy war" being played out by rival international players -- has called for a "flexible" UN presence.

Human Rights Watch urged the Security Council to impose an arms embargo on Syria after the air strike on Aazaz.

"This horrific attack killed and wounded scores of civilians and destroyed a whole residential block," said Anna Neistat, acting emergencies director at Human Rights Watch.

"Yet again, Syrian government forces attacked with callous disregard for civilian life."

It said two rebel Free Syrian Army facilities in the vicinity of the Aazaz attack could might have been targets of the Syrian aircraft, but neither was damaged.

On Wednesday, the FSA claimed a bomb attack targeting a military headquarters near a hotel used by the UN observers, saying it was a warning that it could strike any time at the very heart of the regime.

That's right, Samsung's already capable stylus just got a major boost -- meet the BT S Pen. The device, which received no formal introduction during its host device's launch event, first appeared in the "press kit" bag that attendees received on the way out the door. It's similar in size and shape to the company's Galaxy S Pen Holder Kit, which serves as a sleeve for the standard-issue Note S Pen, but Bluetooth functionality, along with a microphone and tiny speaker, enable the lightweight plastic contraption to double as a wireless headset -- sure to come in handy with the SIM slot-equipped international Note 10.1 flavor.

We caught our first hint of the pen's functionality upon discovering a bundled AC adapter -- that seemed mighty odd. The box also included an unusually beefy user manual and no fewer than five replacement "nibs" (read: stylus tips). Pairing took but a few seconds, and then we were on our way answering calls with a single tap of the talk button. There's also a built-in vibration mechanism, which serves to alert you to incoming calls. Sound quality was solid, but speaking into a pen admittedly felt a bit odd -- you may not draw as many stares as you would if speaking directly into a 10.1, but the seemingly unusual action may still turn a few heads. Otherwise, the S pen functioned as expected.

The packaging is all we have to go off of at this point -- Samsung reps we spoke to didn't know to expect the device today, so there's no pricing or availability info to share. We do know that the it's rated for three hours of talk time and 130 hours of standby, it weighs 21 grams, offers Bluetooth 3.0 compatibility and will work with Galaxy Note devices -- you could use it as a headset with other gadgets, though there wouldn't be much appeal. It also includes a micro-USB charging cable, with the port accessible just above the shirt clip. That's all she wrote for now -- apparently this accessory was available exclusively at today's event, and may not make its way to the US, if it's released at all. New TV ad features disenchanted Obama backers

(AP) ? An independent group supporting Republican presidential candidate Mitt Romney is spending $7 million on television ads in which former Obama supporters explain why they won't vote to re-elect him.

Three voters in the 60-second ad from Americans for Prosperity say they voted for Obama in 2008 but now criticize him for heavy spending, the Democrats' health care overhaul and a lousy economy.

One voter says "the president has not earned re-election in 2012." Another says he worries about the country his grandchildren will inherit and regrets casting his ballot for Obama in 2008.

Americans for Prosperity says the ad will air in 11 states, starting Wednesday.

The group was formed by the conservative billionaire brothers Charles and David Koch (kohk).

FOSS Patents: Copying and misconduct at heart of Apple's and ...

On Sunday, Judge Lucy Koh ordered Apple's and Samsung's lead counsel to meet in person that same day (Apple previously complained that Samsung had not been willing to make its lead counsel available for a meeting) and to file their disputed and undisputed proposed jury instructions until 8?AM local time (Monday). They did so at around 2?AM.

Four weeks ago, their disputed instructions covered more than 360 pages. I analyzed that document, and most of the items I highlighted then are still contentious. This morning's filing is about 100 pages shorter than the one in July, but about half of that reduction is simply due to the fact that at this stage they are discussing only the instructions to be given to the jury after the close of evidence, while the preliminary instructions (given after jury selection) are now water under the bridge.

I will analyze Judge Koh's proposed instructions, which I guess we will see later in the week, or possibly during the weekend, and compare them to what the parties proposed. I guess Apple's proposals will, for the most part, be viewed more favorably than Samsung's, manyY of which are just about muddying the water. But some of Apple's proposals are clearly tendentious, and Samsung is entitled to objective instructions.

Rather than compare this set of proposals in each and every detail to the one made four weeks ago, I'd like to highlight the two high-level themes that appear to be the strategically most important ones.

The single most important question is the relevance of Samsung's alleged (and, in my opinion, well-documented) "copying" to certain legal questions, especially infringement. On this question, the parties' proposals are diametrically opposed. Here's what Samsung would like the jury to be told:

"You have heard allegations by Apple that certain of its designs and patents have been copied. Regardless of whether you as the jury accept this testimony, you may not consider it in deciding whether any patents in this case have been infringed. Copying is not an element of patent infringement. I will give you further instructions on the standards to apply in determining utility patent infringement and design patent infringement. In neither case will evidence of copying or lack of copying be relevant to your deliberations. Evidence of copying, if established, is only relevant as one of several considerations you will need to account for in deciding whether a patent is invalid because it was an obvious design."

Samsung stresses that "[its] proposed instruction on the relevance of allegations of copying is particularly important in this trial because Apple chose to make it a central theme in its case, despite its not being an element in its main legal claims of infringement". As a minor concession, Samsung offers to change the last sentence to this:

"In the event that evidence of copying is established and would be relevant to a particular issue other than infringement, I will provide you with an explicit instruction to that effect."

Apple does not want any instruction to this effect and argues that copying is relevant to more questions than just non-obviousness. Apple lists three examples that Samsung cannot reasonable dispute in my view: indirect infringement (which requires an infringer to know that others will infringe), willful infringement, and trade dress secondary meaning. What's less straightforward to determine is the relevance of "copying" to direct infringement. Patent law is a strict liability regime: even with a 100% independent creation, you can be liable for infringement -- and even with 100% intentional copying, you are not liable for anything if there is no valid patent within the scope of which your copied product falls.

I try hard to separate my personal position from the law. Not only would I like independent invention to be a total defense to patent infringement but I also think that evidence of copying will, on balance, lead to more accurate jury verdicts than most of the other evidence, such as technical analysis, that is presented to, but not really understood by, your average jury member. However, Judge Koh is in a far better position to determine what kind of jury instruction, if any, is appropriate here, and we'll know soon.

What Samsung cites the Federal Circuit opinion on Allen Engineering Corp. v. Bartell Industries, Inc. (2002):

"While copying may be relevant to obviousness, it is of no import on the question of whether the claims of an issued patent are infringed."

Maybe Judge Koh will adopt this and decide that "copying" is irrelevant to direct infringement, but Apple would still be right about indirect infringement, willfulness and trade dress secondary meaning.

Apple argues that "the Federal Circuit has considered copying as relevant to infringement" in other cases than Allen v. Bartell, such as L.A. Gear, Inc. v. Thom McAn Shoe Co.. Samsung denies that this 1993 decision held copying to be relevant to (design) patent infringement, but Samsung uses a disingenuous out-of-context quote to make that argument, claiming that the decision "clearly says that copying is 'an issue not relevant to patent infringement'". But this the full quote from which Samsung omitted the parts that support Apple:

"Melville presented no evidence to counteract the evidence of copying of the patented design. Indeed, Melville admitted copying, offering as its only justification the proposition that copying is prevalent in the fashion industry, an issue not relevant to patent infringement."

In the full quote, one can see that the referenced "issue not relevant to patent infringement" is not "copying" in general but "the proposition that copying is prevalent in the fashion industry". I have previously criticized Samsung for an out-of-context citation: it quoted from a "while" subclause, and the related main clause said the opposite of what Samsung was trying to argue.

There's a key sentence in the L.A. Gear decision that Samsung doesn't even address:

"Substantial similarity is not disputed; indeed, copying is admitted."

Again, we'll see what Judge Koh wants to tell the jury about the relevance of copying to the issue of infringement. If Samsung wins a limiting instruction, it can hope that the jury will properly separate the issues, but if Apple wins and no limiting instruction is given, then it's quite possible that the jury verdict on multiple infringement counts will be strongly influenced by all of the evidence of "copying" that was presented.

In connection with secondary factors of non-obviousness of design patents, Samsung proposed an item (as part of a comprehensive instruction) that Apple claims "goes far beyond the law to excuse Samsung's copying and eliminate the relevance of this factor":

"Did others copy the claimed design? Where parties have a practice of marketing very similar products, however, evidence of copying is not a strong indicator of nonobviousness, but rather a measure of the extent to which parties in the market typically follow developments by their competitors, whether patented or not."

I have to grant it to Samsung that "follow[ing]" is a pretty good euphemism for "copying".

The other big issue surrounding the jury instructions relates to the various sanctions that have been ordered by Magistrate Judge Grewal or at least requested by Samsung. Some of the disputed jury instructions relate only to this set of issues. Judge Koh will have to rule on Samsung's pending motions no later than simultaneously with finalizing her jury instructions. Samsung and Apple disagree not only on whether certain instructions should be given at all but also on how they should be phrased. A single word, such as "relevant", can make a significant difference in how the jury perceives an adverse inference instruction, and that's why they're both fighting so hard over what might ultimately be told to the jury.

In the context of proposed jury instructions, Samsung uses the same tactics as always: it argues that for any wrongdoing the court found on Samsung's part, there's an equivalent on Apple's side. But if one looks at the actual issues, it's clear that Samsung's conduct was far more problematic than Apple's. For example, wherever Apple withheld information for a limited amount of time, Samsung still received it at a time when it was able to make full use of it. That's why Magistrate Judge Grewal imposed tougher sanctions on Samsung, and found that some of what Apple did should not even be told to the jury because it would only create confusion without proving anything.

I believe the final jury instructions will also place the emphasis on Samsung's misconduct as opposed to suggesting that both companies engaged in misconduct of the same kind.
